These Terms and Conditions together with your Order constitute the entire Contract between us and you for the supply of Products. No other Terms and Conditions will apply. The Contract cannot be varied unless we agree to vary it in writing or by email.
Terms and Conditions of Website Use
The generation and forwarding of an order by you using this website (www.clobber.com.au or www.clobberleather.com.au) constitutes an offer to purchase the products from us. All orders are subject to acceptance by us, and are otherwise subject to its general terms and conditions of sale.
The display of products and prices on this website does not constitute an offer by Clobber Australia to unconditionally supply the products at displayed prices. All products and prices shown are indicative only, and are subject to product availability and price changes.
All product descriptions for products that we do not manufacture are either provided directly from the product manufacturer, or based upon information provided directly by the product manufacturer.
We shall not be responsible for any errors or omissions contained in this website. The Customer relies on the information contained in this website at its own risk. The information in this website is supplied on condition that any person accessing or using the information will make his or her own determination as to the accuracy and usefulness of the information.
We reserve the right to make any changes to the information contained in and the layout of this website, including changes to the product range, ordering mechanisms and ordering terms.
Except in respect of implied warranties which cannot be excluded by law, we do not make any representation or warranty about the accuracy, suitability for any purpose, merchantability of, title to or usefulness of the information on and contents of this website or the products we supply.
Except as may be prescribed or implied by law, we shall not be liable for any damages whatsoever (including special, indirect, consequential, or incidental damages or damages for loss of profits, revenue, or loss of use) arising out of or relating to this website or the information contained therein or the products supplied whether such damages arise in contract, in tort, in equity, under statute, at law or otherwise.
General Terms and Conditions of Sale
All goods and services (“Products”) supplied by us are supplied on these terms and conditions.
No order shall be binding on us until accepted by us. An individual contract for the supply of Products, on these terms and conditions, is formed on acceptance by us of an order from you. We reserve the right to accept any order in whole or in part. All orders must be paid for via valid credit card at the time of order placement.
We reserve the right to charge for delivery of the Products at any time, notwithstanding that it may not have previously done so. Administrative fees may also be imposed for cancelled orders or exchanges.
Any products which are defective, which are not otherwise in accordance with the Customer’s order, must be returned to Clobber Australia within 30 days from the purchase date at no cost to the Customer. Products may not otherwise be returned.
Clobber Australia will not accept a returned Product where the Customer has caused the Product to become unmerchantable or failed to take steps to prevent the Product from becoming unmerchantable or the Product has become damaged by abnormal use whilst in the possession of the Customer.
Except for those required or implied by legislation, Clobber Australia gives no express warranty in relation to products and services supplied to the Customer, and the Customer acknowledges that it has not relied on any representation or warranty made by or on behalf of Clobber Australia. Certain legislation may imply conditions and warranties into these terms and conditions. To the extent that such conditions and warranties may lawfully be excluded, all such conditions and warranties are expressly excluded.
Except to the extent the law provides that liability is not able to be excluded, Clobber Australia shall not be under any liability to the Customer in respect of any loss or damage (including consequential or indirect loss or damage or loss of profits) however caused, which may be suffered or incurred or which may arise directly or indirectly in respect of the Products, any services supplied by Clobber Australia or the failure of Clobber Australia to comply with these terms and conditions.
These terms and conditions will apply to the exclusion of all other terms and conditions contained in the Customer’s order. In the event of any inconsistency, Clobber Australia will be deemed, by delivering the Products to the Customer or supplying services to the Customer, to have made an offer to the Customer to sell the Products or supply the services pursuant to these terms and conditions, which offer will be deemed to have been accepted if the Customer retains the Products or accepts the services. Clobber Australia reserves the right to change these Terms and Conditions at any time.
Clobber Australia reserves the right to recover from the Customer all goods and services tax (“GST”) payable in respect of the supply of goods and services to the Customer.
These terms and conditions are governed by and will be construed in accordance with the laws of New South Wales, Australia and the parties agree to submit to the jurisdiction of the courts of that state.
The failure by Clobber Australia to exercise, or any delay in exercising, any right, power or privilege available to it under these terms and conditions will not operate as a waiver thereof or preclude any other or further exercise thereof or the exercise of any other right or power.
Clobber Australia will charge your credit card in Australian Dollars. Your credit card issuer will do the currency conversion to your local currency at the time they process the transaction.
Import Duties and Taxes
Please Note: Prices featured on this website do not include additional charges such as import / customs duties and taxes imposed by your importing country. These charges are the responsibility of the customer. For further details on these charges, please contact your local customs department.
Credit Card Fraud
Whilst Clobber Australia employs the latest in Secure Sockets Layer (SSL) technology software for its transactions with our customers, Clobber Australia will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.
Clobber Australia uses Australia Post as its primary shipping service provider for all parcels shipped both within Australia and Internationally. The shipping options available to users of this website will be as follows: Regular Mail & Express Post for shipments within Australia. Airmail, Insured Airmail, & Express Courier International for international shipments. Clobber Australia may from time to time use other shipping service providers where required to ensure prompt delivery to customers. Where a shipping service provider other than Australia Post is used to deliver a customer’s shipment, Clobber Australia will advise the customer before the item is shipped. Clobber Australia will endeavour to ship all orders within 48 hours of receiving the order. If an order is not able to be shipped within 48 hours, the customer will be advised of the delay.
Shipping & Handling Charges
The customer will be advised of the shipping and handling charges associated with an order at the point of check-out. These charges will vary depending on the size and weight of the parcel as well as the shipping method selected by the customer and the customers delivery address.
Complete the on-line Return Request Form. A customer service representative will evaluate your return request, record all the necessary product return information and issue you with a Return Authorisation number (RA). You must obtain an Return Authorisation number immediately so as to ensure that you are eligible for a replacement or refund.
Send your item(s) to the address below. Please ensure that your Return Authorisation number is clearly displayed on the return packaging. You must ensure your return goods are sent via trackable method otherwise Clobber Australia will not supply any credits or replacements for goods not received.

Goods must be returned within 30 calender days of the purchase date – unworn and unwashed in the original packaging. We will credit your original method of payment, excluding shipping and handling (unless goods are faulty) upon receipt of your goods.
The return must be received by us within thirty (30) calendar days of the Return Authorisation number being issued.
Replacement products will only be shipped after the faulty item has been received by Clobber Australia.
All returns must have a Return Authorisation number.
Any item that is returned to Clobber Australia without a Return Authorisation number will be returned to sender.
Freight will be charged at the standard rate.
